Welcome to Swypebites! We're glad you're here. By using our service, you agree to follow these rules, so please read them carefully. Swypebites is a service offered by Swypebites Pte. Ltd. These terms and conditions are governed by and will be construed in accordance with the laws of the Republic of Singapore where Swypebites is available.

We want everyone to have a positive and safe experience on Swypebites. Here are some things you should not do while using our service:
- Don't engage in illegal activities. Don't take any action that infringes or violates the rights of others, violates the law, or breaches any contract or legal duty you owe to anyone.
- Don't provide false information. Don't post information that you know is untrue, misleading, or inaccurate. Do not engage in any deceptive or fraudulent conduct.
- Don't offer prohibited items. Don't offer any items that are illegal, violate Swypebites' policies, rules, or guidelines, or violate any applicable law, statute, ordinance, or regulation. Please refer to our Acceptable Use Policy for more details.
- Don't victimize anyone. Don't engage in any threatening, abusive, harassing, defamatory, libelous, tortious, obscene, profane, or invasive conduct that violates another person's privacy.
- Don't spam. Don't distribute unsolicited or unauthorized advertising or promotional material, or any junk mail, spam, or chain letters. Don't run mail lists, listservs, or any kind of auto-responder or spam on or through Swypebites.
- Don't harm anyone's computer. Don't distribute software viruses or any other material designed to disrupt the proper functioning of any software, hardware, or equipment on Swypebites, whether it is owned by Swypebites or any other party.
- Don't misuse other users' personal information. While using Swypebites, you may receive information about other users, such as their names, email addresses, and postal addresses. This information is provided solely for participating in Swypebites; do not use it for other purposes, and don't misuse it.
Please note that Swypebites reserves the right to suspend or terminate your account if you violate any of these rules or our policies, or if we believe that your actions may harm Swypebites, our users, or third parties.
Sorry, not our job: What we don't do and are not responsible for
- Swypebites does not guarantee the accuracy, completeness, or reliability of any content posted by users on the platform. We don't endorse such information or content and are not responsible for any disputes or issues that may arise between buyers and sellers.
- Furthermore, we don't guarantee the availability, accuracy, or quality of any products, services, or information offered by sellers on the platform.
- We don't provide any warranties or guarantees of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- You agree that any chargebacks or inquiries from the bank that may arise from transactions when accepting card payments on the platform are the responsibility of the buyers and sellers. You also understand that Swypebites is not involved in the decision-making process of chargeback outcomes. We recommend that appropriate steps be taken to protect against fraud and other risks.
- Swypebites shall not be held liable for any claims or damages that may arise from your use of the platform, including but not limited to direct, indirect, incidental, consequential, or punitive damages. Moreover, we cannot be held responsible for the actions of any third-party websites or services that may be linked to or integrated with the platform. We advise users to be cautious when interacting with such websites or services.
- By using the platform, you release Swypebites from any claims, damages, or demands of any kind, whether known or unknown, suspected or unsuspected, disclosed or undisclosed, arising from disputes or the use of the platform. Please note that all content accessed through the platform is at the user's own risk, and Swypebites is not responsible for any resulting damage or loss to any party.
Using the content at your own risk
- You acknowledge and agree that you use the platform and any content on the platform at your own risk.
- Swypebites do not guarantee that any content on the platform is accurate, complete, or up-to-date. We are not responsible for any damages or losses that may arise from your use of any content on the platform.
- You are solely responsible for verifying the accuracy and completeness of any content on the platform before relying on it for any purpose.
The Price is Right: Our Fees
- Creating an account on Swypebites is free. However, we collect fees for certain paid services, such as using our advertising platform or participating in our creator marketplace. These fees may vary depending on the service and will be clearly stated before you use them.
- Please note that each payment provider is its own company, and we are not responsible for their performance or any issues that may arise. You are also responsible for paying any additional fees or taxes associated with your use of Swypebites.
- If you wish to cancel any of our paid services, your request will take effect at the end of the billing cycle. Please note that any fees paid to us or our payment partners are non-refundable.
- By using our paid services, you agree to pay all fees and charges associated with them. If you fail to pay these fees, we reserve the right to suspend or terminate your access to the service.
Our Payment and Payout Provider
- Payment processing services for User(s) and Merchant(s) on Swypebites are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the "Stripe Services Agreement"). By agreeing to these terms or continuing to operate as a User/Merchant on Swypebites, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of Swypebites enabling payment processing services through Stripe, you agree to provide Swypebites accurate and complete information about you and your business, and you authorize Swypebites to share it and transaction information related to your use of the payment processing services provided by Stripe.
- Swypebites use Stripe to make payouts to Merchant(s). The Stripe Recipient Agreement applies to your receipt of such Payouts. To receive payouts from Swypebites, you must provide us accurate and complete information about you and your business, and you authorize us to share it and transaction information related to your payout with Stripe.
About Refunds
- At Swypebites, we want you to have a great experience with our platform. However, we understand that sometimes refunds may be necessary. Please note that each shop is responsible for their own refund terms and Swypebites does not interfere nor aid in any refund.
- All refund requests and disputes should be made directly with the shop account holder. We encourage you to contact us in the event of an issue, and we will do our best to help mediate the situation. However, ultimately, the shop account holder has the final say in any refund resolution.
- If you have any questions or concerns regarding our refund terms, please don't hesitate to contact us.
What you can't sell here
- At Swypebites, we take compliance and safety seriously. Therefore, certain types of businesses are not allowed to use our Livestream Shop service. Here are the prohibited businesses:
- Investment and Credit Services: If you provide investment advice, credit counseling or repair, or debt reduction services, you can not use our Livestream Shop service.
- Money and Legal Services: If you offer money transfer services, virtual currency or stored value, payday loans, bail bonds, or legal services, you can not use our Livestream Shop service.
- Prohibited Goods and Services: If you sell products or services that are illegal or prohibited by law, such as drugs, weapons, or counterfeit items, you can not use our Livestream Shop service.
- We reserve the right to review and remove any Livestream Shop that violates our terms of service. If you're unsure whether your business is allowed to use our Livestream Shop service, please contact us for clarification.
The Boring but Important Bit
Swypebites reserves the right to modify or terminate any aspect of the services at any time and at its sole discretion. Unless otherwise specified, these terms are intended for your use only, and no third-party beneficiaries are permitted. Any waiver of these terms shall not be deemed to waive any other term or right, and any failure by Swypebites to enforce any provision of these terms shall not constitute a waiver of that provision. Any claims related to the use of our services must be brought within one (1) year of the date the cause of action arose; otherwise, such claims are barred.
